    This Privacy Policy ("Policy") describes how PresalesIQ, Inc. ("PresalesIQ," "we," "us," or "our") collects, uses, discloses, and protects personal data in connection with its proprietary software-as-a-service platform and related websites, applications, and services (collectively, the "Services").

    PresalesIQ provides a business-to-business presales enablement platform designed for commercial use by organizations and their authorized personnel. This Policy applies to personal data processed in the course of providing the Services, including personal data relating to business users, representatives of our customers, website visitors, and other individuals whose personal data may be processed through Customer Data.

    This Policy is intended to meet the requirements of applicable data protection laws, including the EU General Data Protection Regulation ("GDPR"), the UK GDPR, the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"), and other applicable global privacy frameworks. Where PresalesIQ processes personal data on behalf of a customer as a processor, such processing is governed by the applicable data processing agreement or contractual terms with that customer.

    1. PURPOSE AND SCOPE OF THIS PRIVACY POLICY

    This Policy explains:

    • what categories of personal data PresalesIQ collects and processes;
    • the purposes for which such personal data is used;
    • the legal bases relied upon for processing under applicable law;
    • how and with whom personal data may be shared;
    • how long personal data is retained;
    • the rights available to individuals under applicable data protection laws; and
    • how PresalesIQ protects personal data.

    This Policy applies solely to personal data processed by PresalesIQ in its role as a data controller. Where PresalesIQ processes personal data strictly on behalf of a customer as part of Customer Data, the customer is the data controller, and PresalesIQ acts as a data processor. In such cases, individuals should refer to the customer's own privacy notice.

    2. WHO WE ARE AND OUR ROLE

    PresalesIQ, Inc. is a United States–based company providing a cloud-based presales management platform to business customers worldwide.

    For the purposes of applicable data protection laws, PresalesIQ is the data controller with respect to personal data collected directly by PresalesIQ for its own business purposes, including account administration, billing, marketing, website operations, and security.

    With respect to personal data contained within Customer Data processed through the Services, PresalesIQ acts as a data processor on behalf of its customers, subject to the terms of the applicable agreement governing such processing.

    3. APPLICABILITY AND CATEGORIES OF INDIVIDUALS

    This Policy applies to the following categories of individuals:

    • Business Users and Authorized Users: individuals authorized by a customer to access and use the Services on the customer's behalf.
    • Customer Representatives: individuals who interact with PresalesIQ in a commercial, contractual, or support capacity.
    • Website Visitors: individuals who visit PresalesIQ's websites or interact with online content.
    • Trial Users: individuals who access the Services during a free trial period.

    The Services are intended exclusively for business and commercial use. PresalesIQ does not knowingly provide services to, or intentionally collect personal data from, individuals acting in a purely personal or household capacity.

    4. CATEGORIES OF PERSONAL DATA WE COLLECT

    Depending on the context of the interaction and applicable law, PresalesIQ may collect and process the following categories of personal data:

    • Account and Identity Information: name, business email address, job title, company name, and account credentials.
    • Business Contact Information: telephone number, business address, and professional contact details.
    • Usage and Technical Data: log files, IP addresses, device identifiers, browser type, operating system, usage metrics, and interaction data relating to use of the Services.
    • Customer Data Containing Personal Data: personal data included in CRM records, calendar data, uploaded files, call transcripts, or other content submitted to the Services by or on behalf of a customer.
    • Communications Data: information provided in correspondence with PresalesIQ, including support requests and commercial communications.

    PresalesIQ does not intentionally collect sensitive personal data unless such data is included in Customer Data at the direction of the customer.

    5. SOURCES OF PERSONAL DATA

    PresalesIQ collects personal data from the following sources:

    • Directly from Individuals: when users create accounts, communicate with PresalesIQ, or otherwise provide information directly.
    • From Customers: where customers provide personal data about their authorized users or other individuals in connection with use of the Services.
    • From Third-Party Integrations: where customers authorize integrations with third-party systems such as CRMs, calendar tools, or product management platforms.
    • Automatically: through the operation of the Services and websites, including through cookies and similar technologies.
    • Uploaded Content: where personal data is included in files, transcripts, or materials uploaded by users.

    6. HOW WE USE PERSONAL DATA

    PresalesIQ processes personal data for the following purposes:

    • to provide, operate, maintain, and improve the Services;
    • to authenticate users and administer accounts;
    • to enable AI-assisted analysis, insights, and workflow automation within the Services at the direction of customers;
    • to provide customer support and respond to inquiries;
    • to manage billing, payments, and contractual relationships;
    • to monitor, prevent, and address security incidents, fraud, and misuse of the Services;
    • to comply with applicable legal obligations and enforce contractual rights.

    PresalesIQ does not use Customer Data to train artificial intelligence models on a cross-customer or global basis without explicit customer authorization.

    7. AI PROCESSING AND AUTOMATED ANALYSIS

    The Services include features that use machine learning and artificial intelligence technologies to analyze data and generate insights, recommendations, classifications, or summaries.

    AI processing within the Services operates as follows:

    • AI functionality is assistive in nature and designed to support business workflows.
    • Outputs generated by AI features are not deterministic and may vary based on inputs and configurations.
    • AI-generated outputs are not intended to constitute professional advice or final decision-making.
    • PresalesIQ does not engage in fully automated decision-making that produces legal or similarly significant effects on individuals within the meaning of applicable data protection laws.
    • Customers remain responsible for reviewing, validating, and determining how AI-generated outputs are used within their organizations.

    8. LEGAL BASES FOR PROCESSING (GDPR AND UK GDPR)

    Where the processing of personal data is subject to Regulation (EU) 2016/679 ("GDPR") or the UK GDPR, PresalesIQ processes personal data only where a valid legal basis applies. Depending on the context and purpose of processing, such legal bases may include:

    • Performance of a Contract: where processing is necessary to perform a contract with a customer or to take steps at the request of a customer prior to entering into a contract, including the provision of the Services, account administration, customer support, and billing.
    • Legitimate Interests: where processing is necessary for PresalesIQ's legitimate interests, including operating, securing, maintaining, and improving the Services; preventing fraud and misuse; and conducting internal analytics, provided that such interests are not overridden by the fundamental rights and freedoms of the individual.
    • Compliance with Legal Obligations: where processing is required to comply with applicable laws, regulations, lawful requests, or legal proceedings.
    • Consent: where required by applicable law, PresalesIQ will obtain consent prior to processing. Where consent is relied upon, individuals may withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

    9. CUSTOMER DATA AND ROLE ALLOCATION (CONTROLLER / PROCESSOR)

    Personal data processed through the Services may be subject to different role allocations under applicable data protection laws.

    Where personal data is included in Customer Data submitted to or processed through the Services, the customer acts as the data controller, and PresalesIQ acts as a data processor, processing such data solely on the customer's documented instructions and in accordance with applicable contractual terms.

    Where PresalesIQ processes personal data for its own purposes, including account administration, billing, marketing, security monitoring, and website operations, PresalesIQ acts as the data controller.

    Customers are responsible for ensuring that appropriate notices are provided to, and lawful bases obtained from, individuals whose personal data is included in Customer Data.

    10. DATA ISOLATION AND MULTI-TENANT ARCHITECTURE

    The Services operate on a multi-tenant cloud architecture. PresalesIQ implements technical and organizational measures designed to logically segregate Customer Data between tenants, including the use of row-level security and access controls.

    Customer Data is processed on a customer-isolated basis and is not intentionally accessed by other customers. PresalesIQ does not commingle Customer Data for purposes unrelated to providing and securing the Services.

    11. DATA SHARING AND DISCLOSURE

    PresalesIQ may disclose personal data in the following circumstances:

    • to service providers, contractors, and subprocessors who perform services on PresalesIQ's behalf, subject to appropriate confidentiality and data protection obligations;
    • to third-party technology providers, including infrastructure, hosting, analytics, and AI service providers, where necessary to deliver the Services;
    • to comply with applicable laws, regulations, court orders, subpoenas, or lawful governmental requests;
    • in connection with a corporate transaction, such as a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate safeguards.

    12. THIRD-PARTY INTEGRATIONS

    The Services allow customers to integrate third-party applications and systems. When a customer enables an integration, personal data may be transmitted between PresalesIQ and the relevant third party at the customer's direction.

    PresalesIQ does not control third-party services and is not responsible for their privacy practices, security measures, or compliance with applicable laws. Customers are responsible for reviewing and complying with the terms and privacy policies of any third-party services they connect to the Services.

    13. INTERNATIONAL DATA TRANSFERS

    PresalesIQ operates globally and may process personal data in jurisdictions outside the individual's country of residence.

    Where required by applicable law, PresalesIQ implements appropriate safeguards for international data transfers, such as standard contractual clauses approved by relevant authorities or other legally recognized transfer mechanisms.

    Individuals acknowledge that data protection laws in certain jurisdictions may differ from those in their country of residence.

    14. DATA RETENTION

    PresalesIQ retains personal data only for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.

    Customer Data is retained in accordance with customer instructions and contractual commitments. Backup copies of data may be retained for a limited period for security, disaster recovery, and compliance purposes before being permanently deleted or anonymized.

    15. RIGHTS OF INDIVIDUALS (GDPR AND UK GDPR)

    Subject to applicable law, individuals located in the EEA or UK may have the right to:

    • request access to their personal data;
    • request rectification of inaccurate or incomplete data;
    • request erasure of personal data;
    • request restriction of processing;
    • object to processing based on legitimate interests;
    • request data portability.

    16. CALIFORNIA PRIVACY RIGHTS (CCPA / CPRA)

    California residents may have the right to request information regarding the collection, use, and disclosure of personal information, to request deletion or correction of personal information, and to opt out of certain data practices.

    PresalesIQ does not sell personal information or share it for cross-context behavioral advertising. PresalesIQ will not discriminate against individuals for exercising their privacy rights.

    17. OTHER REGIONAL PRIVACY RIGHTS

    Individuals in other jurisdictions may have rights under local data protection laws. PresalesIQ will respond to such requests in accordance with applicable legal requirements.

    18. SECURITY MEASURES

    PresalesIQ implements commercially reasonable administrative, technical, and organizational measures designed to protect personal data against unauthorized access, disclosure, alteration, or destruction.

    Despite these measures, no security system is impenetrable, and PresalesIQ cannot guarantee absolute security.

    20. CHILDREN'S PERSONAL DATA

    The Services are intended for business use and are not directed to children. PresalesIQ does not knowingly collect personal data from individuals under the age of 16.

    PresalesIQ may send service-related communications necessary to provide the Services. Marketing communications will be sent only where permitted by law and may be opted out of at any time.
